D. Jan Duffy, J.D.

D. Jan Duffy, J.D., is the president of Management Practices Group, a San Francisco, California and London, UK based firm that provides employment-related consulting, including independent internal investigations; skills-based education, and expert witness services to management and employees. Clients include public and private sector organizations in professional and financial services, pharmaceuticals; retail, manufacturing, energy, technology, hospitality, agriculture, medical, education, transportation, law enforcement, and other industries.

A former management attorney and advisor, Ms. Duffy practiced employment law from 1976 to 1980 with Jones, Day, Reavis & Pogue of Cleveland, Ohio and Orrick, Herrington & Sutcliffe of San Francisco, both of which primarily represent larger corporations and public agencies. On a part time basis from 1983 to 1991, she served as an employment law and advice practitioner with the San Luis Obispo, CA. firm Sinsheimer, Schiebelhut and Baggett, representing primarily smaller businesses and agencies. Ms. Duffy is a Certified Compliance and Ethics Professional.

A graduate of Stanford and Case Western Reserve University, Ms. Duffy was Professor of Business Law and Policy at California Polytechnic State University from 1980 to 1998, where she taught employment law, critical thinking, government policy and regulation of business, and legal aspects of international business to MBA and undergraduate students. She is the author of numerous articles on harassment, workplace investigations, privacy, and retaliation and a frequent lecturer on employment and compliance matters both nationally and internationally. She has also collaborated with the American Bar Association to produce several videos on employment topics, including “Preventing Workplace Harassment: What Works, What Doesn’t?” “Conducting Workplace Investigations,” and “Preparing For Depositions in Employment Litigation.”

Ms Duffy frequently serves as an expert witness in employment and compliance cases, including sex, race, age, and other harassment and discrimination litigation, as well as retaliation, whistleblowing, internal investigations,  wrongful termination, defamation, privacy, and other common law causes of action. Retained by both plaintiffs and defendants, she specializes in evaluating management practices, including compliance, prevention and correction programs, as well as fact-finding and managerial decision making.

Ms. Duffy has chaired the American Bar Association’s Labor and Employment Section Committees on Technology and on Employee Rights and Responsibilities as well as the latter’s Subcommittees on Institutes (Continuing Legal Education); Privacy; and Class Actions. She is a member of the ABA’s College of Labor and Employment Lawyers, an honorary society for attorneys who have demonstrated outstanding professional leadership in the field.  She is also Founding Member and Chair of the Independent Investigators Association, as well as a Founding Member of the California Association of Workplace Investigators and XBHR (Cross-Border Human Resources Association.)   She is an active author and speaker for the International Bar Association’s Human Resources Committee.
